Definitions & Interpretations

DFS” means the Demand Flexibility Service operated by the ESO

ESO” means the Energy System Operator

Event” means a DFS event that So Energy participates in

Solo” is a subsidiary of SMS Plc, who operate the DFS scheme on behalf of So Energy

MPAN” means Meter Point Administration Number, which refers to the electricity meter from which we measure your electricity consumption

Prize Pool” means the prizes that are made available to customers who participate in the DFS, having met the conditions outlined in Clauses 5, 6 and, 7.

Service” means the combination of the DFS service operated by So Energy and the Prize Pool made available to our customers


1. Interpretation

1.1 The Service will be run by So Energy Limited, a company registered in England and Wales with registered number 09263295 and registered office Studio 2 Power Road Studios 114 Power Road, Chiswick, London, England, W4 5PY (“So Energy”, “we”, “us”).

1.2 These terms and conditions, together with any specific rules set out in any communications relating to the Service, are the Service rules (“Rules”) and apply to this Service. By entering this Service, you are agreeing to be bound by these Rules and any other applicable instructions.

1.3 So Energy reserves the right to cancel or amend the Service and/or the Rules without prior notice. Any changes will be posted on our website.

1.4 In the event of any dispute regarding any aspect of the Service, the decision of So Energy shall be final, and no correspondence will be entered into.

1.5 By entering the Service, you warrant that all information submitted by you is true, current, and complete. If any information you submit is found to be fraudulent or incorrectly completed or if So Energy has reasonable grounds to believe that you have breached any of the Rules, So Energy reserves the right to disqualify you from the Service.

1.6 These Service terms and conditions are separate to the terms and conditions for the supply of gas and electricity that you will have with So Energy and will not affect your rights and obligations under those terms.

1.7 The Service will continue until 31 March 2024 unless otherwise extended by So Energy or cancelled or amended by So Energy in accordance with Clause 2.4.


2. Eligibility & Participation

2.1 There is no entry fee and no purchase necessary to enter this Service. Entrants must be 18 or over. Only residents of Great Britain (excluding Northern Ireland) are eligible to sign up to So Energy and take part in the Service.

2.2 Only one entry per customer.

2.3 To be eligible for the Service, you must:

  • 2.3.1 be on supply with So Energy for at least 30 days;
  • 2.3.2 at all times comply with these Terms & Conditions;
  • 2.3.3 be registered for the Service;
  • 2.3.4 not be participating in any other provider’s service for DFS;
  • 2.3.5 not be participating in a grid balancing service with the ESO or a Distribution System Operator;
  • 2.3.6 have a working electricity smart meter that has been sending us 80% of half-hourly readings for the last 20 days; and
  • 2.3.7 agree to have your MPAN read on a half-hourly basis, and that this information may be used by Solo for the purposes of this Service.


3. Service Delivery

3.1 We do not guarantee that So Energy will participate in every Event.

3.2 Prior to each Event, you will receive a notification of the Event window.

3.3 To be eligible for rewards, you must opt-in to the Event before it begins.3

3.4 We will calculate your normal usage using up to 10 similar days of your recent smart meter history, excluding days where an Event has taken place, to calculate your average consumption (the “Baseline”).

3.5 During an Event you should reduce electricity use as measured by your smart meter compared to the Baseline during any of the half-hours of the Event window.

3.6 If we’re unable to pull your meter readings to calculate your usage from any of the Events, we’ll work it out using an average across all participants.

3.7 If your smart meter becomes disconnected or you move house, we reserve the right to remove you from the Service.


4. Prize Pool

4.1 To be eligible for a prize, you must be on Supply with So Energy at the time of the drawing.

4.2 The Prize Pool tiers will be unlocked based on the cumulative energy savings of all So Energy customers participating in each event (the “Total Energy Saving")

4.3 The size of the Prize Pool will be dependent upon the number of So Rewarding Events and the total amount of energy saved by all the So Energy participants in each Event.

4.4 The Prize Pool will have different levels of prizes (the “Tiers”), with each Tier being awarded when the Total Energy Savings reaches the following thresholds:

  • 4.4.1 The first tier (“Tier 1”) will be awarded at a Total Energy Saving of 3MWh;
  • 4.4.2 the second tier (“Tier 2") will be awarded at a Total Energy Saving of 6MWh (3MWh above the Tier 1 threshold);
  • 4.4.3 the third tier (“Tier 3") will be awarded at a Total Energy Saving of 9MWh (3MWh above the Tier 2 threshold);
  • 4.4.4 the fourth tier (“Tier 4") will be awarded at a Total Energy Saving of 12MWh (3MWh above the Tier 3 threshold);
  • 4.4.5 the fifth tier (“Tier 5") will be awarded at a Total Energy Saving of 15MWh (3MWh above the Tier 4 threshold);
  • 4.4.6the sixth tier (“Tier 6”) will be awarded at a Total Energy Saving of 20MWh (5MWh above the Tier 5 threshold);
  • 4.4.7 the alternative sixth tier (“Tier 6 Alternative”) will be awarded at a Total Energy Saving of 20MWh (5MWh above the Tier 5 threshold) if Tier 6 cannot be awarded as per clause 5.7.3.


4.5 Once Tier 6 has been awarded, the value of the Total Energy Savings pool will be reset and the prize pool will begin again

4.6 So Energy guarantee the award of at least one cycle of each of the six tiers (that being all of Tier 1, Tier 2, Tier 3, Tier 4, and Tier 5, and one of Tier 6 or the Tier 6 Alternative).  Once one award of each of the above has been made, the tiers will become unlocked by the Total Energy Savings alone, which may mean that one or more tiers of subsequent cycles are not awarded by the End Date.

4.7The prizes available at each tier are:

4.7.1 Tier 1, 100 individual awards of £25 Amazon gift vouchers;

4.7.2 Tier 2, Tier 3, Tier 4, and Tier 5 : 1 individual award per tier of free electricity for a year, up to the limit.  This is based on the Ofgem price cap for a typical household as of 01 January 2024, which is £972 per year.  This will be credited to your So Energy account on a monthly basis for 12 months;

4.7.3 Tier 6, one free installation of a solar panel and battery system installation (carried out by So Energy) up to a maximum of 10 panels and one 5kWh battery.  Further details regarding Solar installation opens can be found in Clause 7. If your home is not suitable for a solar installation, you may choose to opt for the Tier 6 Alternative prize.

4.7.4 If so selected, for the Tier 6 Alternative prize you will receive one year of free energy (based on the Ofgem price cap for typical household use of both electricity and gas as of 01 January 2024, which is £1,928 per year, credited to your So Energy account on a monthly basis for 12 months).  You can also nominate 2 friends or family members for the same prize, but they must either be or become So Energy customers to receive said prize.  Further details regarding both Solar installation options can be found in Clause 7

4.8 If you (or in the case of the Tier 6 Alternative, a family or friend) win free electricity or energy for a year as per 5.7.2 and 5.7.4, you are only eligible to receive the credit while you remain a customer of So Energy.  You may transfer this prize to a new property if the account remains in your name, but you must notify us in writing at demandflexibilityservice@so.energy

4.9 Only winners from a prize draw will be notified after a prize draw, however you will be able to see the status of the Prize Draw on our website (https://so.energy)


5. Management of the prize draw

5.1 There will be one prize draw per Tier.

5.2 To be eligible for the Prize Draw you must have reduced your energy consumption by at least 100Wh (0.1 kWh) during the Event compared to your Baseline usage (the “Minimum Reduction”)

5.3 Customers who exceed the minimum reduction will be rewarded with one entry per 100Wh (0.1 kWH) or part thereof of reduction during the Event compared to their Baseline usage (“Prize Entries”)

5.4 Until the Tier 6 prize (or the Tier 6 Alternative) has been awarded, your Prize Entries will continue to accumulate after each Event.  That is, if there are three Events and you earn 5 Prize Entries per Event, at the end of the third Event you will have 15 Prize Entries

5.5 After each event, So Energy will notify you of how much energy you have saved in the Event via e-mail

5.6 The Prize Draw will be conducted by So Energy

5.7 The winners will be randomly selected by computer

5.8 The winners will be announced no later than 2 weeks after the prize draw and will be notified by e-mail or phone call.

5.9 By entering this Prize Draw, you are agreeing to be contacted by So Energy or our selected partners including but not limited to Amazon EU S.à r.l. (using the contact details you have provided us with on your account) should you win. If a winner does not contact So Energy to accept their prize within 5 business days of So Energy attempting to notify the winner, another winner will be selected.

5.10 Prizes are not transferable or exchangeable.

5.11 The Prize Draw is governed by the laws of England and Wales


6. Solar Installation Prize

6.1 The suitability of your property for the installation of solar panels will be determined by us following a home survey. If your property is not suitable for solar installation, or you do not want solar panels, the winner will be able to nominate an alternative person in accordance with 5.7.3. Our decision on the suitability of your property for a solar installation is final.

6.2 If the install is non-standard (the standard being based on an average two storey house) and requires additional parts or labour outside of a standard installation, these costs will need to be covered by the you.

6.3 Before a survey can be carried out, you will need to have all the relevant permissions in place.

6.4 Installations can only be carried out on the UK mainland.

6.5 If the install requires readiness activity that is outside of a standard installation such as but not limited to DNO work, fuse upgrades, asbestos checks, and planning permissions, the effort and cost will need to be borne by you and completed prior to booking your install.


7. Data Protection and Publicity

7.1 So Energy’s privacy policy shall apply to any data collected in connection with this Service

7.2 So Energy will share participants’ Meter Point Administration Numbers, half-hourly metered energy consumption, energy export, usage information and other details relating to the participants with ESO, Solo, its affiliates and their authorised sub processor N3rgy Limited (Party credentials and Party ID of N3RGY LIMITED, incorporated and registered in England and Wales with the company number 11203504 whose registered office is at 4 Ovington Drive, Fleet, United Kingdom, GU51 1DF) to provide the Service including to register participants in the Service and calculate payments to individual participants. Your half-hourly metered consumption and export data from the electricity supply start date associated with your current MPAN will be processed by Solo Energy Limited and N3rgy Limited by interfacing with the national smart meter systems in accordance with the Smart Energy Code (https://smartenergycodecompany.co.uk/).

7.3 By entering this Prize Draw you agree to us using your first name, first letter of your surname and town in relation to the Prize Draw and the promotion, including but not limited to use on the So Energy website and in the media, in materials produced by or on behalf of So Energy and press should you win. So Energy will retain the rights to any media and materials produced.

7.4 Any personal data relating to the winners, or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to any third parties without the entrant’s prior consent.
